  • Balance of Purchase

  • Financing Condition

    • This offer is conditional upon the Buyer(s) or their agent being able to arrange satisfactory financing within _Five_____ (5) business days (excluding Saturday, Sunday and Statutory Holidays) from the date of acceptance of this Offer. This condition is included for the benefit of the Buyer(s) and may be waived, at their sole option, by notice in writing to the Seller(s) or their Agent within the conditional period, failing which this Agreement shall become null and void and the Buyer's deposit shall be returned to them in full without interest or deductions. The Seller hereby acknowledges that it may be a requirement of the Buyer's lender to have an appraiser access the subject property prior to closing.   • Mutual Release

  • Buyer Revisit

    • The Buyer shall be allowed to visit the subject property Two (2) times prior to closing at reasonable times and with twenty four hours notice to the Seller.

  • Liens and Encumbrances

    • The Seller warrants and represents that the heating and air conditioning systems are free and clear of all liens, rental fees and encumbrances. If a rental fee, lien, or any encumbrance is outstanding on the heating and air conditioning systems, the Seller agrees to pay the cost of the contract in full before closing, at the Seller's own expense. Further, the Seller shall provide all documentation to the Buyer on closing. (Except what is listed on Paragraph 6 for rentals)

  • Key transfer on closing

    • The parties agree that the keys to the property shall be left in a lock box at the property and the code the same is to be provided to the Buyer's lawyer in escrow pending closing of this transaction.

  • Cannabis Act

    • The Seller represents and warrants that during the time the Seller has owned the property, the use of the property, including the buildings and structures thereon has not been used for the growth, cultivation, propagation, harvesting or production of any cannabis or cannabis plants within the meaning of the Cannabis Act, S.C 2018 c.16 and the provisions of the Cannabis Act, S.O. 217, C26 as amended from time to time, and that to the best of the Seller's knowledge and belief, the use of the property, including the buildings and structures thereon has never been used for the growth, cultivation, propagation, harvesting or production of any cannabis plants within the meaning of the Cannabis Act, S.C. 2018 c. 16 and the provisions of the Cannabis Act, S.O. 2017, c. 26 as amended from time to time. This warranty shall survive and not merge upon the completion of this transaction.

  • Broom Swept condition

    • The Seller agrees to leave the premises in a clean broom swept condition on closing, free from all debris and all garbage removed from premises and property.
